12 Month Limited Warranty
The DynamicSabers saber ("the saber", "this product") of the original customer that purchased it ("the customer") is warrantied by DynamicSabers LLC ("DynamicSabers") against manufacturing defects in materials and workmanship under normal use for a period of twelve (12) months from the original date of purchase.
DynamicSabers reserves the right to reject any warranty claims that arise from an issue that it does not consider to be a manufacturing defect. DynamicSabers reserves the right to reject any warranty claims made on or after the warranty’s date of expiration, which occurs exactly twelve (12) months from the original date of purchase.
Under this warranty, DynamicSabers may, at its option, either adjust, replace, or repair components of the saber, provide new components ("replacement components") to the customer for them to self-repair the saber, or replace the saber entirely with a brand new one of the same model and color, or, if unavailable, the same model of a different color, or a different model of at least equivalent retail purchase value ("a replacement saber"), depending on what is available to DynamicSabers.
All transportation costs up to an amount of $50.00 USD in connection with sending the saber from the customer to DynamicSabers to adjust, replace, or repair components of it under warranty, in sending replacement components under warranty from DynamicSabers to the customer for them to self-repair the saber, in sending the saber after it is serviced under warranty from DynamicSabers to the customer, or in sending a replacement saber under warranty from DynamicSabers to the customer, will be incurred by DynamicSabers. DynamicSabers may, at its option, select any carrier and shipping service it chooses to ship with.
If transportation costs exceed $50.00 USD, DynamicSabers reserves the right to bill the customer the additional amount exceeding $50.00 USD. If the customer refuses to pay any such additional charges related to the transportation cost, DynamicSabers reserves the right to refuse to give the customer service under warranty.
When the customer is shipping the saber to DynamicSabers for service under warranty, DynamicSabers reserves the right to ask the customer to purchase and generate the shipping label needed to ship the saber. The customer may use their own discretion when picking a carrier and shipping service to ship the saber with. However, it must be a shipping service that includes a tracking number that DynamicSabers can follow along with, and the customer must provide DynamicSabers with the tracking number in the form of a tracking link. DynamicSabers will reimburse the customer for the purchase price of the shipping label, up to an amount of $50.00 USD, if the customer provides DynamicSabers with a receipt from the carrier that clearly states the purchase price of the shipping label that was purchased by the customer to ship the saber to DynamicSabers.
When the customer is shipping the saber to DynamicSabers for service under warranty, all standards and practices regarding the saber’s transportation to DynamicSabers, including the item condition, packaging, shipping process, customs clearance, and all other relevant details related to its transportation, adhere to what is stated in the DynamicSabers return policy. DynamicSabers is not responsible if the saber is lost or damaged during shipment.
When shipping the saber to DynamicSabers for service under warranty, the customer should not include any packaging they wish to be returned, as all shipping materials will be discarded upon receiving the item.
Warranty coverage only extends to the original customer that purchased the saber, and all warranty claims must be started by them alone. This warranty does not apply to any sabers that have not been bought directly from DynamicSabers, such as sabers bought or otherwise acquired from a third party.
Proof of purchase from DynamicSabers is needed in order to obtain service under warranty. DynamicSabers reserves the right to refuse to give any service under warranty to those who fail to provide adequate proof of purchase.
Warranty Exclusions
Anything that DynamicSabers does not consider to be a manufacturing defect in materials and workmanship under normal use is not covered under warranty. Blades, batteries, and any plating on the hilt is not covered under warranty.
Any issues or damage caused by improper usage, an accident, tampering with the saber, general wear and tear of the saber over time, or failure to read and follow the information in the instruction manual, is not covered under warranty.
Any scratches or other damage caused by activities such as dueling, opening the hilt, battery replacement, blade replacement, bumping or scraping the saber against surfaces, dropping the saber, and any other usage by the customer that can alter the saber from its original state, is not covered under warranty.
Any issues or damage caused by the customer’s failure to charge the saber’s battery with only the provided charger that comes with their order, at the maximum charging voltage of five volts (5V), and for the maximum charging time of four (4) hours for a full charge, is not covered under warranty.
Any issues or damage caused by the customer cross threading the provided screws that come with their order inside the hilt is not covered under warranty.
Any issues or damage caused by modifying or replacing any original part of the saber with a third-party part is not covered under warranty.
Any periodic and routine care and maintenance services that are expected to occur through the course of the normal usage of the saber are not covered under warranty.
Any loss of the saber due to negligence, an accident, theft, improper storage, misplacement, shock, disposal, unauthorized usage, improperly performed care and maintenance services, or any other event that results in loss, is not covered under warranty. Water or moisture damage of any kind is not covered under warranty.
If the saber has already been serviced once before under warranty, or if replacement components or a replacement saber has already been sent to the customer once before under warranty, then DynamicSabers reserves the right to refuse to give the customer further service under warranty.
Warranty claims started on or after the warranty’s expiration date, which occurs exactly twelve (12) months from the original date of purchase, will be rejected, due to being ineligible to receive service under warranty as a result of the warranty’s expiration.
Failure by the customer to provide adequate proof of purchase from DynamicSabers will result in a rejection of the warranty claim and a denial of service under warranty.
The preceding list of warranty exclusions is not all inclusive, and DynamicSabers reserves the right to refuse to give service under warranty for anything it does not consider to be within the scope of coverage of this 12 month limited warranty.
Voiding of Warranty
Modifying or replacing any original part of the saber with a third-party part voids this warranty. DynamicSabers solely reserves the ability to deem what it considers an original parts modification or replacement with third-party parts, and has the power to void the warranty of any customer that it deems has performed an action that does so.
Any improperly performed care and maintenance services voids this warranty. This warranty is void if the saber is not bought directly from DynamicSabers, and is instead bought or otherwise acquired from a third party.
Submitting a Warranty Claim
In order to submit a warranty claim, the customer needs to fill out the contact form on the contact us page, and select “warranty inquiry” as the contact reason.
In the content of their message, the customer should detail what specifically is wrong with their saber, what issue or problem has arisen, and why they believe it is a manufacturing defect in materials and workmanship under normal use.
During their communications, the customer may be asked for photos of the saber as well, specifically of the problem they have described, so DynamicSabers can better understand the issue at hand.
The customer should ensure that all communication with DynamicSabers is prompt and respectful and takes their warranty’s expiration date into consideration. If DynamicSabers is contacted on or after the warranty’s date of expiration, which occurs exactly twelve (12) months from the original date of purchase, then it cannot be exercised and service under warranty will not be given.
Limitations of Liability
To the maximum extent permitted by applicable law, this limited warranty and the remedies contained within it are exclusive and in lieu of all other warranties, express, statutory or implied, as to any matter whatsoever, including, without limitation, any warranties of merchantability, fitness for a particular purpose, satisfactory quality, and accuracy, all of which are expressly disclaimed by DynamicSabers LLC. When any implied warranties may not be excluded in their entirety, they will be limited to twelve (12) months from the date of purchase of this product as indicated by this limited warranty.
To the maximum extent permitted by applicable law, DynamicSabers LLC shall not be liable for any incidental, direct, indirect, consequential, special, or punitive damages or liabilities of any kind arising out of or in connection with the sale or use of this product, or resulting from any breach of condition or warranty, whether based in contract, strict product liability, tort (including negligence), or any other legal theory, even if DynamicSabers LLC has been advised of the possibility of such damages, and even if any remedy contained within this limited warranty is deemed to have failed of its essential purpose. DynamicSabers LLC's entire liability under all circumstances shall not exceed the purchase price paid by the customer for this product.
Some countries, states, or provinces do not allow the exclusion or limitation of implied warranties or the exclusion or limitation of incidental or consequential damages, so the above exclusions and limitations may be limited in their application to the customer. This warranty gives the customer specific legal rights, and the customer may also have other rights, which vary from country to country, state to state, and province to province.
